Metro Police patch

FOR IMMEDIATE RELEASE

April 30, 2007

Chief Ronal Serpas this morning was assured that the sub-lease for Club Mystic at 166 2nd Avenue North will not be renewed when it expires on June 30. The location is leased to O’Charley’s, which in turn sub-leases the location to the owners of Club Mystic.

In light of the shootings over the past two weekends outside Club Mystic, Chief Serpas this morning spoke with the corporate leadership of O’Charley’s. O’Charley’s Chief Executive Officer Greg Burns expressed his strong concern about the trouble being caused around Club Mystic and said that his company will not grant any extensions to the sub-lease, which is up June 30.

“I think everyone agrees that there must be a change in what is happening around this club,” Chief Serpas said. “I am very pleased with O’Charley’s response. Between now and June 30, the police department will continue to keep a very close eye on this establishment.”

“While Club Mystic has certain legal rights under their sub-lease with respect to continued occupancy and use of the premises, Club Mystic does not have a right to continued occupancy after June 30, 2007,” Mr. Burns said. “Additionally, and in the interim, we plan to review any other legal options we may have with respect to Club Mystic and their sub-lease.”

So far this year, computer records show more than 80 police responses to 166 2nd Avenue North. Included in that number are several fights/assaults and disorderly persons.
